New Consitution of the Republic of Saltha (NCotRoS)

 

Article I (Root of Law)

The law is not those granted by favor to the people, but given ot the peoplle justrly because it is the right of the people to secure said rights and liberties. granted from Santh.

 

Article II (Equal Rights)

All have equal rights, regardless of race or social status.

 

Article III (Freedom of speach, press and Assembling)

There shall be no law restricting the spoken word or printed word with the condition of false accusation or blasphamy against Santh. There shall be no law preventing the peacefull assembly.

 

Article IV (The senate)

There shall be established a senate of twleve men for each county  to be elected by the people of terms of four years.

A senator shall be a man in good standing with the law, with no more than a single class-I offence in his record and of at least twenty years of age

The higher senate consists of the numbers of all ix counties, numbering sixty in all. For a descision to be made, there must be a quandry of two-thirds of the senators present. That is, there must be a quarrum of at least eight senators in a lower seante, and fourty senators in an upper senate. A majority on any descision must be aproved by two-thirds of senators present. All senators shall be duely compensated paid from the treasury of the goverment. The goverment shall have the power to enfore this through might of the branches, services and millitary.

 

 

 

Article V - (Senate's use for Mediation)

 For complaints against another ciizen where the complaint is in exess of value of 10 gold coins, the person may take their case before the lower senatel. The descition of the lwoer senate may be apealed and brought before the higher senate. The request for apeal must be made within seven days of the descision of the lower senate.

 

Article VI- (Purjery)

It is a class-II (flogging) offence to lie to a senator while under oath.

 

Article VII (Rights of an accused)

Those who others have greivences against have the right to be brought before the senate and hear the accusations against them and speak in their defence. No one shall be puinished for a crime unless there is a sure definition of the accused's guilt.

 

Section a

No person or property shall be searched or seized without a probibe cause of guilt.

section b

Accused have the right to apeal a desction of the lesser senate by apealing before the higher senate. The request of apeal must be made before sentencing is carried out.

The accused has the right to enter a guilty plead in order to recude a sentence by one quarter of the penalty. This does not apply for crimes for which the penalty ascribed is death.

 

Article IX  (Punishment)

No method of punishment shall be used except those ascribed in the constitution. No punishment shall be given that is excesive.

 

Section a

On first and second offence fo a non serious crime, a child (under ten years of age) having a legal guardian shall be not tried by the goverment, but instead handed over to their legal guardian.

On the third offence of a minor crime, or first offence of a serious crime, the goverment has the right to punish the child.

 

Section b

  For minor crimes commited by children, such as petty theft, Run away slaves and assualt where the victem is not permently injured the accused shall receive with a rod ofs no less than 5 lashes and no more than 10 across the bared backside. These are classified as type Im crimes

 

Section c

 For minor crimes commited by adults including but not limited to assault where the victem has damage that causes no lasting harm, kidnapping, theft by threat of harm and death by negligence the person shall recieve no less tha 20 lashes and no more than 30 lashes with a whip. These are classified as class I crimes.

 

Section d

 For serious crimes commited by adults including but not limtied to assult where the victem ahs perminent debilitating damage done that lasts for one month or more, or at least three convictions of kidnapping or theft shall receive no less than 30 lashes and no more than 40 lashes.

 

Section e

 For acts of treason or murder, or numberous repeats of no less than five convictions of violent crimes such as kidnapping or assult where the victem(s) are injured for a long period of at least a month or more shall by punished by death by beheading. These are class II crimes

 

Article X (Property)

All have right to property and ownership with shall not be infringed without due compisatioin

 

Article IX (Accountability of Goverment)

The people have the right at any time to review records of descisions by all senators made freely avalible to the public,

 

Article X (Prohibition of Classes and Castes)

No law or privilage shall be given to a class or caste of people because of the sole reason of beloning to that class or caste. The rate of taxes, when applied in need shall always be at the same

rate for all free citizens.

 

Article XI (Prohibition of retroactive laws)

 No one shall be charged of an act that was at the time legal.

 

Article XII (Rights of Slaves)

No slave may be beaten beyond what a free person would receive for a comprable offence. If a slave is found to have been mistreated by a worker in the ministry of forced labor,  he may bring it before the senate and if they descide that the slave was beaten in a way that far exeeds what would be comprable that slave is set free.

 

A man who kills in cold blood a slave shall be charged with murder as he would against a free man.
